Third is a private record-keeping tool, not an emergency or crisis service
You must be 18 or over to use the app
We can’t monitor your records or intervene in real time
Your records are encrypted and designed to stay private, including from us
You are responsible for keeping your device and recovery details secure
You remain responsible for how you export or share records outside the app
We can’t guarantee records will be accepted as legal evidence or lead to any specific outcome
We may suspend accounts that misuse the platform or attempt to harm its security
If you delete your account, your data is permanently deleted and cannot be recovered

These Terms of Use (“Terms”) explain how you may use the Third app (“Third app”, “Third”, “the app”).
Please read these Terms carefully before using the app.
By creating an account or using the Third app, you agree to these Terms.
If you do not agree to these Terms, you should not use the Third app.
These Terms should be read alongside our Privacy Policy and Safeguarding Policy. -
The Third App is provided by 1 in 3 Women CIC (“we”, “us”, “our”).
1 in 3 Women CIC is a company registered in England and Wales.

1 in 3 Women CIC acts as the data controller for personal data processed through the Third app.
The intellectual property rights in the Third app are owned by Third Technologies Ltd and licensed to 1 in 3 Women CIC for the purpose of providing the app as a free service. -
The Third app is designed to support private record keeping.
It is not:An emergency service
A crisis support service
A live monitoring service
A legal advice service
A medical service
A replacement for professional support
A guarantee of personal safety
We do not monitor user content or receive real-time alerts.
Due to the end-to-end encrypted nature of the platform, we cannot routinely view, monitor, assess or intervene in the information users record within the app.If you are in immediate danger or require urgent support, contact emergency services or an appropriate support organisation.
Please consider your personal safety when using the app, particularly if another person may have access to your device, accounts, backups or notifications. -
The Third app is intended only for users aged 18 and over.
By using the app, you confirm that:
You are at least 18 years old
You are legally capable of entering into these Terms
You will use the app only in accordance with these Terms and applicable law
We do not knowingly permit use of the app by anyone under the age of 18.

You may create an account to use the Third app.
You do not need to provide your real name.
You are responsible for:Maintaining the security of your device
Keeping your passcodes, PINs and recovery details secure
Ensuring that others cannot access your account without permission
All activity carried out through your account
If you choose to use account recovery features, you are responsible for maintaining access to your recovery method.
Because Third app uses end-to-end encryption, we may not be able to recover your data if:
You lose access to your device
You lose access to your recovery credentials
You delete your account
Deleting the app from your device may not remove:Exported files
Screenshots
Device backups
Cloud-store copies
You remain responsible for managing these separately.

The Third app allows users to privately record and organise information relating to experiences including abuse, harassment, coercion or other harmful behaviour.
The app is designed as a private documentation and record-keeping tool.
The information you choose to record remains under your control.
Your personal logs and uploaded files are protected using end-to-end encryption.
This means:Your information is encrypted before leaving your device
We cannot routinely access or read your encrypted records
We cannot moderate or review encrypted content in normal operation
You remain responsible for deciding:
What you upload
What you export or share
How you use the app
Whether sharing information is safe or appropriate in your circumstances

You are responsible for using the Third app safely, lawfully and responsibly.
You agree that you will:Use the app only for lawful purposes
Comply with applicable laws and regulations
Consider your own safety and the safety of others when using the app
Keep your account and device secure
Ensure you have the legal right to upload, store, export or share material using the app
You are responsible for any consequences arising from:
Sharing exported material
Allowing others access to your device or account
Storing exported content outside the app
Misuse of exported records

You must not use the Third app:
In a way that breaches applicable law or regulations
To interfere with or disrupt the operation or security of the app
To attempt unauthorised access to systems or accounts
To distribute malware, malicious code, or harmful material
To impersonate another person or organisation
To harass, abuse or threaten others through the platform
For spam, fraudulent activity or deception
To misuse exports or information obtained through the app
In a way that infringes intellectual property or privacy rights
The Third app is intended to support private documentation and record keeping.
Users may choose to upload material that documents harmful, abusive or unlawful behaviour as part of that purpose.
We do not interpret the presence of such material alone as misuse of the platform. -
The Third app may allow you to export records and files.
Export links are temporary and are designed to expire after 72 hours.Once information is exported or shared outside the app:
You are responsible for how it is stored, shared or used
We cannot control third-party access to it
We cannot guarantee its continued security
Please consider your personal safety before exporting or sharing information.
This includes considering:
Who may access the material
Whether devices or accounts are shared
Whether cloud backups may store copies
Whether exporting information could place you at additional risk

The Third app is not a legal advice service.
We do not provide legal advice, legal representation or evidential certification.
We do not guarantee:That records created using the app will be admissible in court
That exported files will meet evidential requirements
That timestamps or metadata will be accepted by any authority
Any specific legal outcome
Features such as timestamps, organisation tools or exports are provided to assist users in maintaining personal records.
Users remain responsible for how exported material is used, shared or relied upon.
If you require legal advice, you should seek support from a qualified legal professional or appropriate support organisation.

The Third app is currently free of charge.
We may introduce optional paid features in future, including additional storage beyond standard account limits.
Where paid features are introduced:Pricing will be communicated in advance
Subscriptions may renew monthly unless cancelled
Prices may change over time
Users may stop using paid features at any time
Refunds will not usually be provided for partially used billing period
We may apply storage limits or usage restrictions to accounts.

All intellectual property rights in Third app, including the software, design, branding and associated materials, are owned by or licensed to Third Technologies Ltd.
Nothing in these Terms transfers ownership of the app or its intellectual property to users.
Users retain ownership of the content and records they upload or create using the app.
By using the app, you grant us only the limited rights necessary to:Operate the service
Maintain security and functionality
Provide requested features
Comply with legal obligations

We are committed to protecting user privacy.
Our Privacy Policy explains how personal data is collected, used and protected.
The Third app uses end-to-end encryption for personal logs and uploaded files.
Because of this:We cannot routinely access encrypted records
We cannot recover encrypted data without appropriate credentials
Some rights requests may be technically limited in relation to encrypted content
You should read our Privacy Policy carefully before using the app.

Our safeguarding approach is explained in our Safeguarding Policy.
Due to the encrypted nature of Third app:We do not routinely monitor user records
We do not receive real-time alerts
We are not able to intervene in individual situations through encrypted app content
We do not routinely report incidents to police, social services or other authorities on behalf of users.
If safeguarding concerns are raised directly to us outside encrypted channels, we may:
Provide signposting information
Respond appropriately and respectfully
Take action where required by law
If you are in immediate danger, contact emergency services or an appropriate crisis support organisation.

We may suspend, restrict or terminate access to the Third app immediately where we reasonably believe:
These Terms have been breached
The app is being misused
Unlawful activity is taking place
There has been harassment, impersonation, or abusive behaviour
There is attempted interference with the security or operation of the app
It is necessary to protect users, systems or the service
We are not required to provide advance notice before suspension or termination.
You may delete your account at any time within the app.
Where an account is deleted:
Associated data is permanently removed from active systems
Limited secure backups may temporarily retain data for technical reasons before deletion through normal cycles
Deleted accounts cannot be restored
We may also delete inactive accounts in accordance with our Privacy Policy.

We aim to provide a reliable and secure service, but we do not guarantee that the Third app will always be:
Available
Uninterrupted
Error-free
Secure from every possible risk or attack
We may:
Modify features
Suspend access temporarily
Carry out maintenance
Update or discontinue parts of the service
We are not responsible for failures caused by:
Device issues
Internet connectivity
Third-party services
App store providers
Unauthorised access to your device or accounts

Nothing in these Terms excludes liability that can legally be excluded under applicable law.
To the fullest extent permitted by law, we are not liable for:Indirect or consequential losses
Emotional distress arising from use of the app
Loss of opportunity
Loss arising from device compromise or shared device access
Actions taken by third parties
Misuse of exported records
Decisions made based on information stored within the app
Inability to recover encrypted information where access credentials are lost
Any harm, abuse or unlawful conduct experienced by users
Users remain responsible for their own personal safety decisions and for determining whether use of the app is appropriate in their circumstances.

We may update, modify or improve the Third app over time.
This may include:
Changing features
Introducing new functionality
Applying storage limits
Introducing optional paid features
Improving security measures
We may also discontinue parts of the app where necessary.

We may update these Terms from time to time.
Where changes are significant, we will take reasonable steps to inform users, including through the app or by email where appropriate.
Continued use of the Third app after updated Terms comes into effect constitutes acceptance of those updated Terms.

These Terms are governed by the laws of England and Wales.
Any disputes arising in connection with these Terms of the Third app will be subject to the exclusive jurisdiction of the courts of England and Wales. -
